Asylklagen haben immer weniger Erfolg

Die Quote der Asylbescheide, die erfolgreich beklagt wurden, ist im ersten Halbjahr 2019 auf 14,5 Prozent gesunken. Das geht aus der aktuellen Gerichtsstatistik des Bundesamtes hervor, die der Düsseldorfer "Rheinischen Post" vorliegt.

 

Dagegen hatte die Quote im vergangenen Jahr noch bei 17 Prozent und im Jahr 2017 bei 22 Prozent gelegen. Dem BAMF zufolge gab es im ersten Halbjahr 80.301 Gerichtsentscheidungen über Asylbescheide.

 

Gerichte entschieden über 175.000 Klagen

 

Davon fielen 11.647 positiv für den Antragsteller aus. Im Jahr 2018 entschieden die Gerichte über insgesamt 173.416 Klagen gegen Asylbescheide, davon waren 29.703 erfolgreich für den Asylbewerber. In gut 41 Prozent der Fälle habe das Gericht die Entscheidungen des Amtes bestätigt, so die Behörde. Bei den restlichen 44,2 Prozent der Fälle handele es sich um so genannte "sonstige Verfahrenserledigungen".

 

Jeder zweite Asylbescheid wird beklagt

 

Dabei ging es etwa um Fälle, bei denen Flüchtlinge ihre Klagen zurückzogen oder das BAMF den erwünschten Schutzstatus doch noch erteilte. Fast jede sechste erfolgreiche Asylklage betraf im ersten Halbjahr Flüchtlinge aus Syrien oder Afghanistan, so das Bundesamt. Weiterhin werde gut jeder zweite Asylbescheid beklagt. Dies sei bei insgesamt 102.489 oder 50,5 Prozent aller Asylbescheide im ersten Halbjahr 2019 der Fall gewesen. Falle der Bescheid negativ aus, werde sogar in knapp 75 Prozent der Fälle geklagt. pm, ots

The decisions of the Federal Office for Migration and Refugees (BAMF) on asylum applications by refugees are increasingly rarely overturned by courts. In the first half of 2019, the number of successful asylum applications dropped to 14.5 percent. Courts rule on 175,000 complaints

 

Of these, 11,647 were positive for the applicant. In 2018, the courts ruled on a total of 173,416 complaints against asylum decisions, 29,703 of which were successful for the asylum seeker. In a good 41 percent of the cases, the court confirmed the decisions of the office, according to the authority. The remaining 44.2 percent of the cases were so-called "other procedural settlements".

 

Every second asylum decision is a complaint

 

These included cases in which refugees withdrew their complaints or the BAMF still granted the desired protection status. According to the Federal Office, almost every sixth successful asylum application in the first half of the year concerned refugees from Syria or Afghanistan.
