Trotzdem soll die Weisung an die Jobcenter nun auch für die Gruppe der jungen Leistungsbezieher gelten, wie das Ministerium auf Anfrage der "NOZ" mitteilte. Bundesarbeitsminister Hubertus Heil (SPD) schließt demnach aus, "dass künftig innerhalb eines Monats mehr als 30 Prozent sanktioniert werden darf". Dies gelte auch für die Fälle der unter 25-Jährigen, erklärte ein Sprecher. "Eine dementsprechende Weisung wird nach Abschluss des konsultatorischen Verfahrens am Freitag ergehen."
Das Gericht hatte die Sanktionspraxis zum großen Teil gekippt
Mit der vom Ministerium und der Bundesagentur für Arbeit erarbeiteten Weisung wird geregelt, wie die Jobcenter das Urteil des Bundesverfassungsgerichts anzuwenden haben, bis eine gesetzliche Regelung dazu in Kraft tritt. Das Gericht hatte die bisherige Sanktionspraxis zum großen Teil gekippt. Demnach dürfen bei Pflichtverletzungen die Leistungen höchstens um 30 Prozent gekürzt werden - bislang mögliche Kürzungen von 60 Prozent oder sogar der komplette Wegfall der Leistungen sind laut Verfassungsgericht mit dem Grundgesetz unvereinbar. Mit seiner Stellungnahme dementierte das Arbeitsministerium zugleich einen Bericht, wonach es auch nach dem Hartz-IV-Urteil des Verfassungsgerichts Kürzungen des Existenzminimums um mehr als 30 Prozent ermöglichen wolle.
