Damit ist das Gremium entscheidun-gsunfähig. „Die Lösung von Handels-streitigkeiten durch das Gericht ist aber sehr wichtig für Deutschland als Export-nation“, sagt Martin Braml, Wissen-schaftler am Zentrum für Außenhandel des Ifo-Instituts.
„Es ist sehr bedauerlich, dass ausscheidende Richter wegen des Vetos der USA seit einigen Jahren nicht nachbesetzt werden können“, ergänzt Braml.
Schnell eine Ersatzlösung finden
Es sei entscheidend, schnell eine Ersatzlösung zu finden. Deutschland solle das vorantreiben. Eine Lösung sei jedoch derzeit nur außerhalb der WTO möglich. Man könne ein Gremium etablieren, das von allen Staaten außer den USA anerkannt werde und das die Aufgaben des WTO-Berufungsgerichtes vorübergehend übernehme.
Integrität der WTO wird konterkariert
„Das bringt die Gefahr mit sich, dass die Integrität der WTO konterkariert wird. Daher ist das nur eine zweitbeste Lösung“, sagt Braml. „Langfristig sollte das alte Gremium wiedereingesetzt und einige Bedenken der USA berücksichtigt werden, etwa wie weit die Befugnisse der WTO-Richter gehen sollen.“ Kritisiert wurde immer wieder, dass das Berufungsgericht das Handelsrecht eigenständig weiterentwickelt hat, ohne die Zustimmung der WTO-Mitgliedstaaten einzuholen. pm, ifo

The Ifo-Institute has demanded that a replacement solution be found quickly for the failing appeal court at the World Trade Organization (WTO). On 10 December 2019, the term of office of two of the remaining three judges expires. This means that the panel is unable to reach a decision.
"However, the resolution of trade disputes by the court is very important for Germany as an export nation," says Martin Braml, a researcher at the Centre for Foreign Trade at the Ifo Institute. "It is very regrettable that it has not been possible to fill the vacancies of departing judges for several years due to the US veto," Braml adds.
Finding a replacement solution quickly
It is crucial to find a replacement solution quickly. Germany should push this forward. However, a solution is currently only possible outside the WTO. A body could be established which would be recognised by all states except the USA and which would temporarily take over the tasks of the WTO Court of Appeal.
Integrity of the WTO thwarted
"This entails the risk of undermining the integrity of the WTO. It is therefore only a second-best solution," says Braml. "In the long run, the old body should be reinstated and some US concerns taken into account, such as how far the WTO judges' powers should go.
