Einigung der Länder über Online-Glücksspiele

Nach Informationen der "Rheinischen Post" haben sich die Chefs der Staatskanzleien der Bundesländer auf ihrer Konferenz am vergangenen Wochenende geeinigt. Die Ministerpräsidenten der Länder können den Vertrag nun bei ihrem Treffen Anfang März paraphieren.

 

Dann bedarf der Staatsvertrag noch der Zustimmung aller Landtage. Noch vor der Paraphierung durch die Ministerpräsidenten soll im Februar in Düsseldorf eine Verbändean-hörung zum neuen Staatsvertrag stattfinden. Mit der Einigung ist die Gefahr, dass nach Ablauf der bisherigen Übergangsregelung in Deutschland ein Flickenteppich unterschiedlicher Länderregelungen für das Online-Glücksspiel entsteht, vom Tisch. Ein solcher Flickenteppich wäre vor allem vor dem Hintergrund, dass Online-Glücksspiel vor keinen Grenzen halt macht, wenig sinnvoll gewesen.

 

Datei für Online-Spieler soll entstehen

 

Der neue Staatsvertrag sieht auch vor, dass eine neue deutschlandweite Zentralbehörde entstehen soll, die für die Genehmigung und Kontrolle der Online-Glücksspiele zuständig sein soll. Mithilfe der Behörde soll außerdem eine spielerübergreifende Datei für Online-Spieler entstehen. Sie wird Daten von jedem erfassen, der im Internet an Glücksspielen teilnimmt. Spieler, die als spielsüchtig auffallen, können gesperrt werden. Offen ist einzig, in welchem Bundesland die Zentralbehörde, die die Form einer Anstalt des öffentlichen Rechts (AöR) bekommen soll, ihren Sitz erhalten wird.

 

Kosten für Zentralbehörde teilen sich die Bundesländer

 

Nathanael Liminski, der Chef der NRW-Staatskanzlei und Verhandlungsführer der CDU-geführten Länder, hatte schon früher bestätigt, dass NRW seine Bereitschaft erklärt hatte, die Behörde zu errichten. Es sei aber keine Bedingung für die Zustimmung von NRW zum neuen Staatsvertrag, die Behörde zu erhalten. Die Kosten für die Zentralbehörde sollen sich die Bundesländer teilen. Zwar soll die AöR dem Finanz- oder dem Wirtschaftsministerium des Landes zugeordnet werden, in dem der Sitz der Behörde ist, doch werde die Behörde unabhängig agieren können, und der jeweilige Minister werde keine Weisungsbefugnis gegenüber der AöR haben, hieß es in Kreisen der Landesregierung.

The 16 German federal states have agreed on a new State Treaty on Gambling. The treaty, which is to apply from mid 2021, will in future allow sports betting, online casino, online poker and virtual slot machines as well as advertising for them. File for online players to be created

 

The new State Treaty also provides for the establishment of a new central authority throughout Germany, which will be responsible for the licensing and control of online gambling. With the help of the authority, a cross-player file for online gamblers is also to be created. It will collect data from everyone who participates in gambling on the Internet. Players who are known to be gambling addicts can be blocked. The only open question is in which federal state the central authority, which is to take the form of an institution under public law (AöR), will be located.

 

Costs for central authorities are shared by the federal states

 

Nathanael Liminski, the head of the NRW State Chancellery and negotiator for the CDU-led states, had already confirmed earlier that NRW had declared its willingness to establish the authority. He said, however, that it was not a condition for NRW's approval of the new state treaty that the Authority be maintained. The costs for the central authority are to be shared by the federal states. Although the AöR is to be assigned to the Ministry of Finance or the Ministry of Economics of the state in which the authority is located, the authority will be able to act independently, and the respective minister will have no authority to issue instructions to the AöR, it was said in circles of the state government.
