Der Verfassungsschutz kann die Berliner AfD somit auch mit nachrichtendienstlichen Mitteln beobachten, etwa durch das Anwerben von V-Leuten oder das Abhören von Telekommunikation.
Der Sprecher der für den Verfassungsschutz zuständigen Berliner Senatsverwaltung für Inneres wollte eine Anfrage zu der Einstufung mit Verweis auf das Berliner Verfassungsschutzgesetz nicht kommentieren.
Einstufung laut Gesetz zulässig
Die Bekanntgabe einer Einstufung als Prüf- oder Verdachtsfall ist laut Gesetz unzulässig. Eine öffentliche Information darf erst erfolgen, wenn der Verfassungsschutz eine Vereinigung als gesichert extremistisches Beobachtungsobjekt einstuft.
AfD gerät weiter unter Druck
Die AfD gerät durch die von mehreren Quellen bestätigte Einstufung des Berliner Landesverbandes als "Verdachtsfall" weiter unter Druck. Zuvor hatten bereits die Verfassungsschutzbehörden von Brandenburg, Sachsen, Sachsen-Anhalt und Thüringen die jeweiligen Landesverbände der Partei als Verdachtsfall klassifiziert. Auch das Bundesamt für Verfassungsschutz hatte die Bundespartei so eingestuft. Die AfD hatte dagegen allerdings erfolgreich geklagt.
Im März als Prüffall kategoriersiert
Der Berliner Verfassungsschutz hatte die AfD im März 2020 zunächst also sogenannten "Prüffall" kategorisiert. Bekannt wurde dies im Januar dieses Jahres, nachdem ein bisher nicht identifizierter Mitarbeiter des Verfassungsschutzes einen behördeninternen Entwurf für einen Zwischenbericht an die AfD durchgestochen hatte. Die Partei hatten das Papier danach an mehrere Medien lanciert.
Keine verfassungsfeindliche Bestrebungen
Der Verfasser des Berichts hatte die in dem Prüfverfahren gesammelten Wortbeiträge von AfD-Mitgliedern in dem Entwurf zwar als "sarkastisch und teilweise grob verallgemeinernd" gewertet. Ausreichende Anhaltspunkte für verfassungsfeindliche Bestrebungen erkannte er "in der Gesamtschau" aber nicht.
Methodische Mängel des Entwurfs
Die Berliner Innenverwaltung hatte in der Folge auf "methodische Mängel" des Entwurfs verwiesen. Erkenntnisse seien nicht nach "geltenden Standards" bewertet, entscheidende Gesichtspunkte nicht ausreichend berücksichtigt worden. In seiner endgültigen Bewertung des Prüfverfahrens sah der Berliner Verfassungsschutz die gesetzlichen Anforderungen für die Einstufung als extremistischen "Verdachtsfall" nun als erfüllt an. pm, ots

The Berlin Office for the Protection of the Constitution has classified the Berlin state branch of the AfD as an extremist so-called "suspect case". This was confirmed independently by several security politicians from the parliamentary sphere to the "Berliner Morgenpost".
The Federal Office for the Protection of the Constitution can thus also observe the Berlin AfD with intelligence means, for example by recruiting informers or intercepting telecommunications.
The spokesperson for the Berlin Senate Department of the Interior, which is responsible for the protection of the constitution, did not want to comment on an enquiry about the classification, referring to the Berlin law on the protection of the constitution.
Classification permitted by law
According to the law, the announcement of a classification as a case of investigation or suspicion is not permitted. Public information may only be given if the Office for the Protection of the Constitution classifies an association as a certain extremist object of observation.
AfD comes under further pressure
The AfD has come under further pressure after several sources confirmed the classification of the Berlin regional association as a "suspected case". Previously, the constitutional protection authorities of Brandenburg, Saxony, Saxony-Anhalt and Thuringia had already classified the party's respective state associations as suspect cases. The Federal Office for the Protection of the Constitution had also classified the federal party as such. However, the AfD successfully appealed against this.
Categorised as a test case in March
In March 2020, the Berlin Office for the Protection of the Constitution had initially categorised the AfD as a so-called "test case". This became known in January of this year after a previously unidentified employee of the Office for the Protection of the Constitution had leaked an internal draft of an interim report to the AfD. The party had subsequently launched the paper to several media outlets.
No anti-constitutional aspirations
The author of the report had admittedly assessed the verbal contributions of AfD members in the draft, which had been collected in the review process, as "sarcastic and in part grossly generalising". However, he did not see sufficient indications for anti-constitutional aspirations "in the overall view".
Methodological shortcomings of the draft
The Berlin interior administration subsequently referred to "methodological deficiencies" in the draft. Findings had not been evaluated according to "applicable standards" and decisive aspects had not been sufficiently taken into account. In its final assessment of the review process, the Berlin Office for the Protection of the Constitution now considered the legal requirements for the classification as an extremist "suspect case" to be fulfilled. pm, ots, mei
